General Rental and Sales Conditions

GENERAL RENTAL CONDITIONS – RESIDENCES ALL SUITES - APPART HOTEL

Article 1 – APPLICABLE REGULATIONS

This rental contract is subject to the Tourism Residence Status. Therefore, the legal provisions concerning accommodation leases are not applicable, in particular concerning the maintaining in the apartments. The use of Residence as personal property, whether for personal or professional use, is strictly prohibited.

Article 2 - RESERVATION

The reservation of an apartment in ALL SUITES Appart Hotel Tourism Residence is valid only after it has been confirmed to the customer. The confirmation of the reservation by ALL SUITES Appart Hotel Tourism Residence is entirely at the Residence’s discretion. To be confirmed, the reservation must be guaranteed by a valid credit card issued by an establishment of good repute (1), or must have been subject to a previous credit agreement with ALL SUITES Appart Hotel Tourism Residence, or must be guaranteed by a deposit. The aforementioned deposit will correspond to 30% of the amount of the whole stay and will be paid before arrival in order to confirm the reservation. For the rental of an apartment, for a stay longer or equal to a month, the amount of the deposit will be calculated on the first month’s rent. The confirmed bookings by ALL SUITES Appart Hotel Tourism Residence will be kept up tol the option date given during the initial booking. If the customer fails to pay the deposit or the demanded guaranties, the reservation will be automatically cancelled. Bookings made seven days before the scheduled arrival date must be guaranteed by a valid credit card issued by an establishment of good repute (1). Group bookings (more than 8 apartments and made by the same organization) are subject to the group general booking terms, that is to say the total prepayment of the whole stay at least two weeks in advance.

Article 3 – PAYMENT TERMS

The rental contract, made in two copies and corresponding to the planned duration, will be signed by the resident who will accept, therefore, the general rental conditions. Internal rules and inventory will also be signed by the resident (at the latest one day after arrival).
The prepayment of the stay, specified in the rental contract, must be paid on arrival for the whole length of the stay. Without prepayment, ALL SUITES Appart Hotel Tourism Residence will not give the keys to the apartment. For stays longer than one month, the payment of the monthly rent will be paid by the resident on the first day of each month. If the payment of the stay is made by a company having contracted a commercial agreement, the resident will be personally responsible and accountable for the payment. For rental agreements of 3 months, monthly rent will be paid on the first day of the month. Without total payment on the first day of the month, ALL SUITES Appart Hotel Tourism Residence can break up the rental agreement and can ask the customer to leave the apartment immediately. The payment of the optional services will be required on the presentation of the corresponding invoice. The maximum credit accepted by ALL SUITES Appart Hotel Tourism Residence for the optional services is up to 50€.

Article 4 - RATES

The prices are in Euros and include a fully furnished apartment, with a television, water and electricity. Optional services and tourist tax are not included in the price. Apartment and service rates for the year are revised and applicable from January 1st of each year.

Article 5 – DEPOSIT

In order to guarantee the good accomplishment of the rental agreement, the resident must pay a deposit. The amount of the deposit is fixed in function of the stay’s duration and stipulated on the back of this document. The deposit will be returned in the delay of 2 months after the departure of the resident under the following conditions: after the keys are returned, in absence of damages in the apartment, and after payment for eventual optional services. ALL SUITES Appart Hotel Tourism Residence will retain the deposit in order to repair damages and to replace missing items.
If this deposit is not enough to cover the expenses, the resident is engaged irrevocably to complete the cost of the extra expenses.

Article 6 - RESERVATION OR STAY DURATION MODIFICATIONS

Subject to availability and at Residence’s discretion, a stay can be extended, without any obligation to give the same apartment or the same price. In the case of an extended stay and application of a new price, this will be applicable from the date of the extended rental agreement.

In the case of an agreed early departure of the initial rental contact, the resident or his company must notify in advance the front office in order to readjust the rates, in the following delays. At least 48h in advance for a stay of less than 7 nights. At least 5 days in advance for a stay between 7 and 29 nights. At least 10 days in advance for a stay between 30 nights and more. At least 1 month in advance for stay higher than 3 months. Le prix applicable sera celui correspondant à la durée ainsi écourtée et la facturation depuis la date d’arrivée originelle sera due et réglée en totalité.

Specific case All Suites - Appart Hotel la Teste De Buch

Subject to availability and at Residence’s discretion, a stay can be extended, without any obligation to give the same apartment or the same price.
In the case of an extended stay and application of a new price, this will be applicable from the date of the extended rental agreement.
In the case of an agreed early departure of the initial rental contact, the resident or his company must notify in advance the front office in order to readjust the rates, in the following delays :

Low Season :

  • At least 48h in advance for a stay of less than 7 nights.
  • At least 5 days in advance for a stay between 7 and 29 nights.
  • At least 10 days in advance for a stay between 30 nights and more.
  • At least 1 month in advance for stay higher than 3 months.

High season: Holidays schools / Summer
In the case of early departure, the stay will not be reimbursed.

Article 7 – CANCELLATION/ NO SHOWS

All cancellations must be done at least 48 hours before arrival. For long stays (30 nights and more), the cancellation must be done at least 72 hours in advance. All cancellations received less than 48 hours before the scheduled arrival date will be subject to a cancellation penalty equal to :
- One night for all stay of less than 7 nights,
- Two nights for stays between 7 and 29 nights, et
- the advance of 30% (or equivalent invoice) will be retained for stays of 30 nights and more. In case of no-show, the customer will be subject to the cancellation penalties specified here above. The effective date of a written cancellation will be the date received by the residence.

Specific case All Suites - Appart Hotel la Teste de Buch

Low season, no cancellation charges will be asked for all cancellations received more than 24 hours before the previous arrival date, except for stays longer than 29 nights. For all long stays, the cancellation must be sent at least 72 hours in advance.
All cancellations received less than 24 hours before the scheduled arrival date will be subject to a cancellation penalty fee equivalent to :
- One night for all stay of less than 7 nights,
- Two nights for stays between 7 and 29 nights and
the advance of 30% (or equivalent invoice) will be retained for stays of 30 nights and more.
High season : Holidays school / SUMMER
- cancellation received between 30 and 45 days before the scheduled arrival date, 10 % of the amount of the stay will be retained.
- cancellation received between 15 and 29 days before the scheduled arrival date, 20 % of the amount of the stay will be retained.
- cancellation received between 7 and 14 days before the scheduled arrival date, 30 % of the amount of the stay will be retained.
- cancellation received between 2 and 6 days before the scheduled arrival date, 50 % of the amount of the stay will be retained.
- cancellation received the day before the scheduled arrival date, 80 % of the amount of the stay will be retained.
In case of no shows, the total amount of the stay will be retained.
The effective date of a cancellation will be the date of the written cancellation received by the residence.

Article 8 - DUTIES OF THE RESIDENT

The apartment shall be made available to the resident in good working and maintenance order. The resident will use the rented space and facilities in order to not disturb the other residents of the Residence. The resident must return the rented space cleaned and in perfect working and maintenance order. The internal rules signed on arrival of the resident must be entirely respected. If the resident does not respect these rules, the Manager can break the rental contract and ask the customer to leave the apartment. There is an inventory for each apartment. The resident must check the accuracy and the good working order on arrival and advise the front office of any problems, of any missing or damaged items, or at the latest one day after arrival. On departure of the resident, ALL SUITES Appart Hotel Tourism Residence will check the inventory and the cleanliness of the apartment, or if any items are missing or damaged, ALL SUITES Appart Hotel Tourism Residence will invoice the resident.
ALL SUITES Appart Hotel Tourism Residence reserves the right to enter in rented apartments for maintenance or safety. In any cases the resident can not change the access system of the apartment.

Article 9 - LIABILITY

The provisions of Articles 1952 and following of the Civil Code concerning hotels are not applicable. Consequently, ALL SUITES Appart Hotel Tourism Residence cannot be held responsible in case of robberies or deteriorations of personal effects in the apartments, common areas, parking and any other outbuildings or annexes of the Residence; the present contract is subject to the Tourism Residence status.

Article 10 - TERMINATION – PENALTIES – NON-RENEWAL

This contract shall be legally terminated, immediately and informality, if the resident does not respect his duties or if his behaviour is not acceptable to other residents. The resident will have to leave the Residence immediately and if necessary, the resident can be ejected by public forces.

(1) ALL SUITES Appart Hotel Tourism Residence accepts following credit cards: American Express, Visa, Diners, and Mastercard.

GENERAL SALES CONDITIONS – ALL SUITES HOTEL LE TEICH

Article 1 - RESERVATION

These sales conditions are applicable to all reservations made to the front office or by post, fax or email. Elle ne sera effective qu’à compter de la confirmation par l’Hôtel ALL SUITES HOTEL de LE TEICH ; les modalités de celle-ci restant à l’entière discrétion de l’Hôtel (accusé de réception par mail, fax, document de réservation écrit …).
To be confirmed, the reservation must be guaranteed by a valid credit card issued by an establishment of good repute (1), or must have been subject to a previous credit agreement with ALL SUITES Appart Hotel Tourism Residence, or must be guaranteed by a deposit. The aforementioned deposit will correspond to 30% of the amount of the whole stay and will be paid before arrival in order to confirm the reservation. For the rental of an apartment, for a stay longer or equal to a week, the amount of the deposit will be calculated on the first month’s rent. Ils devront être versés à l’avance afin que la réservation soit considérée comme confirmée. Pour les chambres et la durée de séjours de moindre importance, le versement desdits arrhes restera à la libre appréciation de l’Hôtel.
The confirmed bookings by HOTEL ALL SUITES Le Teich will be kept up tol the option date given during the initial booking.
If the customer fails to pay the deposit or the demanded guaranties, the reservation will be automatically cancelled.
Bookings made seven days before the scheduled arrival date must be guaranteed by a valid credit card issued by an establishment of good repute (1). Payments are authorized by simple check, approved holiday voucher, or credit card ( 1 ). The ALL SUITE - HOTEL LE TEICH can't be held as person in charge in case of refusal to pay or of meadow payments emanating from the banking institution of the customer.

The payment of the optional services (as breakfast) will be required on the presentation of the corresponding invoice. The
maximum credit accepted by ALL SUITES Appart Hotel Tourism Residence for the optional services is up to 50€.

Article 7 - LIABILITY

The Hotel ALL SUITES - HOTEL LE TEICH is held by the guarantee of conformity of the services, by virtue of articles L212-1 and following ones of the Code of the consumption, and the consequential damage according to articles 1952 and following ones of the Civil code.
Consequently, ALL SUITES - HOTEL LE TEICH cannot be held responsible in case not realization or bad realization of the conditions of reservation due to the cases of absolute necessity, because of a third party or of the very customer.
If a claim cannot be settled between the hotel and the customer, concerning the validity, the interpretation or the fulfillment of the sales agreement, it will be subject to the opinion of the court competent jurisdiction.

Article 8 - TERMINATION – PENALTIES – NON-RENEWAL

This contract shall be legally terminated, immediately and informality, if the resident does not respect his duties or if his behaviour is not acceptable to other residents. The resident will have to leave the Residence immediately and if necessary, the resident can be ejected by public forces.

Article 9 - ACCOMODATION

The hotel is an entirely nonsmoking area. The customer can check in from 2 PM on the day of his arrival and must check out at maximum 11 AM on the day of departure. All damages made by the customer during his stay will be invoiced as well as the key room loss. The hotel cannot be held responsible in the case of robberies or deteriorations of personal effects in the common areas, in a room unlocked or in the car park.
Small pets are accepted with an extra payment of 2 € per day. Food and beverage consumption, except delivered by the hotel, is forbidden.
